Assault Charges

Simple Assault 

Under Pennsylvania law, a person is guilty of simple assault when he or she attempts to cause or intentionally, knowingly, or recklessly cause bodily injury to another. Simple assault charges are generally graded as misdemeanors.  Examples of simple assault charges include physical fights or domestic altercations.

A person may be charged and convicted of simple assault if he or she attempts by physical menace to put another person in fear of imminent serious bodily injury.  Using the same examples, if a person uses threatening language to commit harm against another person and takes immediate action by raising his or her hand to slap another person, injury or contact is not required to obtain a conviction for simple assault.

Aggravated Assault

In Pennsylvania, the Commonwealth can increase a simple assault charge to aggravated assault. Aggravated Assault is graded as a felony depending on the facts and circumstances. A person can be convicted of aggravated assault if he or she: 

• Attempts to cause serious bodily injury to another, or causes such injury intentionally, knowingly, or recklessly under circumstances manifesting an extreme indifference to the value of human life;
• Attempts to cause intentionally, knowingly, or recklessly causes serious bodily injury to certain protected individuals. This includes law enforcement, firefighters, district attorneys, judicial officers and others; or
• Attempts to cause or intentionally or knowingly causes bodily injury to another with a deadly weapon.
